FARM OWNER’S ASSOCIATION:

 

RULES:

 

1.      The unspoiled beauty of the veld, and the fauna and flora thereof, must be protected as far as possible.

 

2.      Ownership of the game that has been introduced on the property (value R 1,2 million ) will vest in the Farm Owner's Association and they shall have the exclusive rights to the offspring thereof.  Hunting is prohibited except when approved of by the majority of the members at an annual general meeting, and then only to reduce the surplus game. Capture and sale will take preference to hunting. All income derived from sale of game will be for the Farm Owner's Association’s account.

 

3.      Only one dwelling will be allowed to be built on each property. (Or portion thereof that falls within the area fenced for game) No member will be allowed to put up any building within 200 meters from any house that has been put up already at the stage that the member applies for the necessary approval from the Municipality and other government departments.

 

4.      The colour and style of all buildings must fit in with the environment. Building plans must be submitted to the building committee and the relevant state departments and municipality for approval. All roofing of any building erected shall consist of thatch or corrugated metal sheeting, painted green.

 

5.      Members, their friends and family will be allowed to move freely on other member's property on condition that their right of privacy will at all times be respected.

 

6.      All members, their family and friends will also be allowed to use the roads on Lekker Rus, over one another's property, at a maximum speed of 20km/h. (Roads that end at a home will be treated as a private road). Members will only be allowed 1 vehicle per day for game viewing and only for non-commercial purposes.  Motor-bikes and "quad bikes" will not be allowed at all.

 

7.      Members will be liable for an annual levy, the amount of which will be fixed at the annual general meeting of all members, and will be used for the maintenance of all roads and fences. The decision of how funds are spent will be taken by a 2/3 majority of the members of the meeting. (It is projected that the initial levy will amount to approx. R200/month. This levy will be payable from date of registration.)

 

8.      No pets will be allowed.

 

9.      No member will be allowed to do anything that will pollute the water or environment.

 

 

10.     Each member will be supplied with a key or combination to access the properties referred to in paragraph 17                            

 

11.     No member will be allowed to apply for sub-division of his property.

 

12.     No member will be allowed to put up a hotel or guest house on his property, or to run any industry

         or business on the property. A member will however be entitled to let his house when not used by

         such member)

 

13.     No member will be entitled to erect any fences on or around his property.

 

14.     No generators will be allowed on any member’s property. All owners may install solar power systems if

         they require electricity. Owners will have the choice of obtaining water from existing water sources or drilling a borehole on their property. Costs involved for access to or delivery of water will be for the owners/members account.

 

15.      The boundary fence with the adjacent property belonging to Besemkop Ontwikkelings has by

          arrangement been opened to owners, enabling them access to a further 450 hectares. In

          consideration thereof Besemkop Ontwikkelings will be allowed to operate a maximum of 8 game drives

          per day on the Lekker Rus properties, utilising game viewing vehicles and under the guidance of a tour guide.   Besemkop Ontwikkelings will in addition contribute 40% of gross income of the  game drives to

         the Farm Owners Association.

 

16.      No alterations to these rules will be made except by a majority vote of at lease 90% of all the

          members at a general meeting.   Any resolution requiring members to contribute towards any capital expenditure or to   the purchase of game can also only be taken by a 90% majority vote.

 

17.     All owners or future owners of the following properties will be members of the Farm Owners

          Association and will have the right to vote at any meeting of the aforementioned  association.

         Votes will be allocated at 1 vote per property as follows:

If any of the aforementioned properties are consolidated, the number of votes will be amended so

that the consolidated property has only one vote.

 

18.       Any disputes that may arise from these rules must be referred to arbitration according to

           Act 42/1965.

 

19.       If any discrepancy exists between the Afrikaans and English versions hereof, the Afrikaans version

           will take precedence over the English version.
